For decades, foreign staffing and outsourcing firms have taken advantage of loopholes in a US visa program meant to bring in high-skilled workers to make up for a lack of domestic tech talent. Amid an immigration crackdown the Trump administration contends is based in part on protecting American jobs, here's how middlemen keep gaming the visa system at the expense of US workers and many others.

It's a concerning issue when companies create fake job postings as part of a strategy to justify hiring foreign workers on H-1B visas. This practice, often referred to as "job laundering" or "H-1B laundering," can have serious implications for both the U.S. workforce and the integrity of the labor market.
Here's how it typically works:
False Job Postings: Companies post job advertisements with requirements that are either unrealistically high (e.g., requiring 20 years of experience in a field where most professionals only have a few) or overly specialized, making it nearly impossible for U.S.-based candidates to qualify.
Exaggerated Difficulty: They may claim that they were unable to find suitable local talent because the job is so complex or rare, even though there are qualified U.S. workers who could do the work.
Low Compensation: In some cases, these positions offer wages below market rates, which align with H-1B visa regulations but are significantly lower than what a capable U.S. worker might expect for similar work.
Unfair Competition: This practice can create an unfair competitive environment where qualified U.S. workers are passed over for jobs they could perform because companies prioritize cheaper foreign labor.

The real middle man trick wasn't properly disclosed I feel. Even the staff in US embassies are on the take

These visas are legalized indentured labor. Companies buy h1bs from each other and many h1bs beneficiaries subcontract under a company and PAY their company to keep them on and not cut their visa while they find work. This allows them to stay and act as private contractors but the company holding the h1b gets a large cut of the individuals hours. Its a sick system that has been exploited by some of the worst people you can imagine. I recently learned of a CEO who blackmailed one of his h1b employees and took his entire home in the US.
The guy from TCS has balls, these people are dangerous and have no qualms about using violence should he ever return to India.

Over the past year, I’ve applied to over 300 jobs I was perfectly qualified for. I spent hours crafting cover letters and tailoring resumes for but was always delivered silence.
Out of those hundreds of applications, I heard back from less than a dozen. And of those few responses, not one resulted in a real opportunity. After months of disappointment, I began to wonder if the problem was with me. But the more I spoke to others, the clearer it became: many of those jobs were never real to begin with.
It turns out, many companies post job listings not to hire U.S. workers, but to check a box for immigration paperwork — especially for H-1B visa or PERM green card filings. These so-called “jobs” are designed so narrowly, or buried so deep on obscure websites, that no one has a real shot. Some friends working in tech told me that they were asked to apply to their own companies just to help fulfill a quota for someone else’s visa filing. That’s when it hit me: we are being used as props in a process we don’t even benefit from.
Do you know what it feels like to stay up until 2 AM perfecting a resume for a job that doesn’t exist? To wait for weeks, refreshing your inbox, only to get silence or a generic auto-reply? To prepare for an interview that never comes — because there was never any real intention to hire you?
It’s exhausting. It’s humiliating. And above all, it’s unfair.
I am not against skilled immigration. America has always been a place where global talent thrives. But when the system is abused to exclude qualified Americans under the pretense of a labor shortage that doesn’t exist, something is deeply broken. We’re not losing jobs because we’re unqualified — we’re losing them because we were never being considered in the first place.
Please consider creating a central, government-run job portal where any company that wants to file a petition or extension an H-1B or PERM application must post their job publicly and transparently. Make it mandatory for those jobs to be visible to U.S. citizens for a fixed period. Let us apply and get a fair shot before companies are allowed to claim no qualified American could be found. Track which companies repeatedly post roles but never interview or hire Americans. Flag the abusers. Hold them accountable.
This isn’t just about economics. It’s about dignity. It’s about restoring faith in a system that too often feels rigged against us.
Thank you for taking the time to read this. I speak not just for myself, but for thousands of Americans who are quietly giving up hope — not because we can’t work, but because we’re locked out by a process that pretends we don’t exist.

Not just TCS or other outsourcing companies, you should also look at traditional, so-called American companies that are misusing H1B visas. They hire these outsourcing companies to obtain cheap labor; it has nothing to do with skill. The same is happening with all these companies opening indian subsidiaries to move jobs from the US to India. So they have already planned the backup option in case the H1B visa ever goes under scrutiny.

and now these companies are moving into other countries because the original host demand more wages and better working conditions. Corporations are just going to get richer around the world while us common folks are just mindlessly funneling their bank accounts.

are semiconductors for AI included? The US desperately needs to diversify from tsmc basically a monopoly, the usA is opening here also other south eastern countries

I am always amazed by how Microsoft escapes being talked about in videos and news stories like this. This company has laid off thousands just as approval for thousands more visas come through to them and their staffing partner Cognizant. On a smaller scale this is Oracle's history as well.

IT Staffing companies (small and big) needs to be audited very frequently. They are the ones who game the system to the full extent.
@VN-ux2ep
It is high time these Indian tech companies like TCS, Infosys etc are not given anymore H1Bs. Those employees are not the best of the best. They are just below average cheap labour, secretly enjoying the benefits if any of working abroad.
@abish83
Its high time they are not given EB1C GC. That is perfect abuse. its one thing to give h1b visa but its annoying to give someone GC through Eb1C category when many hard working immigrants are waiting for years in backlog.

The Indian company TCS needs to be investigated by the FBI and Interpool as soon as possible because they conduct fraudulant activities in all countries they are active, across the USA and Europe as well. There is allot of information out there about their fradualent activities, many witnesses that can confirm.

Lol, Seeing how many Western nations convicted Bankers of 2008 GFC and Corporates for 2010 Deepwater Horizon Disaster, I have complete Faith in Western judiciary and your leaders.

Thing is none of these is illegal. Well mostly what’s discussed here. It’s simply saving costs for the client companies like Apple, Microsoft, Harley and pretty much 1000 other companies.
Move the mundane, low skill jobs to a cheaper country and pay their wages instead of paying 60k in the USA. That’s what this video is about.
Sadly however, international students and many who are legit talented affected by this as well. Cause make no mistake, there is a severe dearth of higher ed graduates and skilled applicants locally.

Why not Ban TCS Infosys and such companies from H1B eligibility

Just when u thought you knew every corrupt angle of America.... nope you hear about more in episodes like this.
This corporate corruption will never change and will ALWAYS keep the Rich - rich and the poor - replaceable

This overlooks the trend of layoffs for Americans and remote workers are hired in other countries, thereby skipping this entire visa process. It’s a massive industry for Americans to get laid off and replaced by teams of IT workers remotely in other countries.
@vikeng21
The notion that people on H1B are Smart is a total Lie. With AI coming in hope it will be removed and the abuse stopped.
@minobs4737
People with H1B generally have a specialized degree and skills, not necessarily smart but skilled in a particular field. There are exceptions but this is the norm. Many doctors (especially rural ones) and healthcare workers are on H1B. cancelling it will just result in shortages

20 years ago, when I graduated from school, there were scholars talked about the world being flat for the next 20years, meaning that corporations will be hiring people from all over the world and employees will be competing with talents worldwide.
It surprises me that, until today, some Americans still believe they’re entitled to jobs simply because they’re born Americans.
@ruslanmishiyev9815
Why are we importing IT employees to support monitors or printers? There are millions of unemployed Americans willing and able to do that job. That is not the kind of job H 1B was meant for.
@sheldonfernandes3588
Maybe because nobody wants to move to a cold city in the middle of nowhere? Sponsoring a visa is not easy it still requires a lot of money and paper work. It's easier to hire local workers. Although the consulting companies do make it easier to import talent. It's definitely not cheaper than hiring local.

In 2016 my salary as an android dev(not some code monkey) was 300\\\\$/ month in Mumbai. So think instead of paying 5000\\\\$/month vs 300\\\\$ /month / 400\\\\$/month makes a huge profit
